Terms of service

These terms cover your use of Esby: GST Invoicer India ("Esby", "the app"), provided by Esby, a sole proprietorship based in New Delhi, India. Installing the app means you accept them.

They are written in plain English on purpose. If anything here is unclear, email support@esby.app and you will get a straight answer.

1. What the app does

Esby creates GST tax invoices and credit notes from your Shopify orders, emails them to your customers, and produces GSTR-1 and Tally exports. It reads your products, orders and locations. It does not write anything back to your store.

2. What it is not

  • It is not tax or legal advice. Esby applies the GSTIN, HSN codes and tax rates that you enter. Whether those are the right ones for your business is a decision for you and your accountant.
  • It does not file your returns. It produces the worksheets you use to file. It has no connection to the GST portal.
  • It does not do e-invoicing. Invoices are not registered with the government's IRP and carry no IRN or QR code. If your turnover requires e-invoicing, Esby alone is not sufficient.

3. Your responsibilities

  • Entering a GSTIN, business details, HSN codes and tax rates that are correct for your business, and keeping them up to date.
  • Setting your Shopify store's base currency to INR. Esby reads amounts in your store's base currency, and will warn you if it is not rupees.
  • Reviewing your invoices. The app is careful, but you are the person legally responsible for the documents your business issues.
  • Keeping your own copies of anything you need for your records, particularly before you uninstall.

4. Plans and payment

Paid plans are billed by Shopify and appear on your normal Shopify invoice. Esby never receives or stores your payment details. Prices are shown on the pricing page and inside the app.

  • Paid plans include a free trial. You can cancel from the app's Plans screen at any time and drop back to the free plan.
  • The price you approved when subscribing is the price you keep paying. A later price change applies to new subscribers only.
  • Charges already made are not refunded on cancellation. If something went genuinely wrong, write in — this is handled case by case rather than by rule.
  • Each plan includes a monthly order allowance. On a paid plan, going over it does not stop your invoices; you are asked to move up a plan.

5. The free plan

The free plan covers up to 50 invoices a month. If you go past that, you get seven further days with everything working normally. After that, new invoices are still created and still numbered — your records stay complete — but their PDF, the customer email and downloads pause until you upgrade or the month resets. Nothing is deleted, and everything returns as soon as either happens.

6. Fair use and suspension

The free plan exists so that small stores can use the app properly, not so that large ones can avoid paying for it. Where a store is clearly working around the plan limits — for example by installing repeatedly to reset a count, or by splitting one business across several stores for that purpose — the app's invoicing may be paused for that store.

You will be emailed before that happens, and it is reversible: pausing never deletes anything and never disturbs your invoice numbering. Suspension is also possible where the app is used unlawfully, or in a way that damages the service for other merchants.

7. Availability

Esby aims to be available at all times but does not promise uninterrupted service. Hosting providers, Shopify and email providers all occasionally fail. Where an order cannot be invoiced immediately, the app retries by itself and shows anything outstanding on its Sync health screen, so a temporary outage delays an invoice rather than losing it.

8. Your data

What is collected, why, how long it is kept and how to have it erased are set out in the privacy policy, which forms part of these terms. In short: only what is needed to produce your invoices, never sold, and deleted when you uninstall.

9. Liability

Esby is provided as it is. To the extent the law allows, Esby is not liable for indirect or consequential losses — including tax penalties, interest, lost profit or lost business — arising from your use of the app. Total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim arose.

Nothing here limits liability for fraud, or for anything that cannot be limited under Indian law.

10. Ending it

You can uninstall Esby from your Shopify admin at any time, which cancels any subscription and stops all processing. Download anything you need first — once the app is removed it can no longer serve you files, and your data is deleted in line with the privacy policy.

11. Changes to these terms

These terms may change as the app develops. The date at the top shows when they last did. Where a change materially affects you, it will be announced in the app or by email rather than made quietly.

12. Governing law

These terms are governed by the laws of India, and the courts of New Delhi, India have jurisdiction over any dispute.
